Chafiq Ayadi fails to challenge terror designation

Chafiq Ayadi, designated on October 19, 2001 by the UN Sanctions Committee, followed by the European Union the same day, sued the Council and Commission of the European Union to obtain the annulment of these measures on August 26, 2002. On July 12, 2006, the First Instance Court of the European Court of Justice (ecj_press_release.pdf) denied the claim and ruled that “the freezing of funds, financial assets and other economic resources of the persons identified by the Security Council as being associated with Usama bin Laden, the Al-Qaeda network and the Taliban is not incompatible with the fundamental rights of the human person falling within the ambit of jus cogens, in light of the public-interest objective of fundamental importance to the international community which is to combat by all means, in accordance with the Charter of the United Nations, threats to international peace and security caused by terrorist acts” The Court ruling on Chafiq Ayadi, a former director of the Muwafaq Foundation comes ahead of an appeal ruling in the case of Yassin Al Kadi, former executive director of Muwafaq.
